Wireless Acceptable Use Policy

The City of Bunnell provides wireless Internet connectivity within certain facilities owned by the City of Bunnell for users with wireless enabled devices.

Summary:

The City of Bunnell provides a wireless network for the purpose of accessing the Internet, for its customers, users, employees, and guests/patrons within certain facilities.  The City utilizes a network filter compatible with the Children’s Internet Protection Act (CIPA) of 2000.  Use of the City of Bunnell wireless network is governed by all local, state, and federal laws, and this wireless Network AUP. The City of Bunnell offers the network as a free service and does not provide technical support for such.

Authority:

By using the City of Bunnell Wireless Network, users are granting permission for authorized network administrators to monitor and/or intercept some electronic communications. Access that is necessary to render services or to protect the property of the provider of the services (City of Bunnell) is allowed under the Electronic Communications Privacy Act of 1986 (ECPA). The City of Bunnell does not monitor personal communications on a regular basis, but may do so on occasion to monitor network performance and to ensure adherence to this AUP and all applicable local, state and federal laws. Users of City of Bunnell computing resources must comply with all applicable federal, state and local laws, and the terms of applicable contracts including software licenses while using City of Bunnell computing resources. Examples of applicable laws, rules and policies include, but are not necessarily limited to, the laws of libel, privacy, copyright, trademark , obscenity and child pornography; the Florida Computer Crimes Act, the Electronic Communications Privacy Act and the Computer Fraud and Abuse Act, which prohibit "hacking," "cracking" and similar activities. Users who engage in electronic communications with persons in other states or countries or on other systems or networks may also be subject to the laws of those jurisdictions and the rules and policies of those other systems and networks.

Responsibilities of Network Users:

The primary purpose of the Bunnell network is to provide a convenient means of Internet access within City facilities.

1. You must log on to the Bunnell Wireless Network, and accept this AUP to be granted access to the internet. 

2. You will need to ensure that you have the appropriate compliant wireless adapter on your device.

3. You must respect all copyrights. The downloading or sharing of copyrighted materials is strictly prohibited.

4. The running of programs, services, systems, processes or servers by a single user, or group of users, that may substantially degrade network performance or accessibility will not be allowed. Electronic chain letters, mail bombs, and excessive recreational use of the network are prohibited. Any action which promotes or furthers pornographic or inappropriate usage is prohibited. Connecting to "Peer to Peer" file sharing networks or downloading large files, such as CD ISO images, is prohibited.

5. Wireless internet access is inherently insecure. Accordingly, you should adopt appropriate security measures when using the Bunnell Wireless network. Also be aware that as you connect your devices through the wireless network, you expose them to: worms, viruses, Trojan horses, denial-of-service attacks, intrusions, packet-sniffing attacks and other abuses by third-parties. The City of Bunnell highly discourages the conducting of confidential transactions (such as online banking, etc.) over any wireless network, including our own. There are risks in using any information, software, services or products found on the Internet. It is your obligation to understand these risks before retrieving, using, relying upon, or purchasing anything via the Internet.

6. You are responsible for all devices you connect through Bunnell Wireless network.

7. You are responsible for securing your own wireless equipped devices prior to making connections to the Bunnell Wireless network.

8. Wireless technology is a shared resource; therefore, speeds will be directly affected by the number of simultaneous users.

Limitations of Wireless Network Access:

1. The City of Bunnell is, in no way, liable for any damage, undesired resource usage or detrimental effects that may occur to your device and/or software while you have your device attached to the wireless network.

2. You are solely responsible for any actions taken by your device, whether intentional or unintentional, that causes damage or otherwise affects other devices or users of the network or the City of Bunnell.

3. You hereby release the City of Bunnell, from liability for any loss, damage, security infringement or injury which you or any third party may sustain as a result of being allowed access to the wireless network. You also agree to be solely responsible for any such loss, infringement, damage, or injury.

The Service provided is access to the Internet. Therefore, the City of Bunnell makes no representations concerning content on the Internet.

Public Records Notification Any information provided by you to the City of Bunnell, including but not limited to feedback, questions, comments and suggestions is non-confidential and subject to the Florida Public Records Law. The City of Bunnell has no obligation of any kind with respect to such information and is free to reproduce, use and disclose the information to others without limitation. In addition, records of usage of the service, including the number of users, length of the session and sites visited may become public records subject to public inspection pursuant to the law.
